Terms of Use

Artoc;e 1 (Purpose)

This agreement is intended to regulate the terms and procedures for using all services (hereinafter referred to as "Services") provided by Blueback Global Services KR Ltd. (hereinafter referred to as the "Company") on the Company's website (https://blueback-gs.kr/).

Article 2 (Definitions)

The definitions of the terms used in this agreement are as follows:

  1. User: The person who receives the services provided by the Company in accordance with this agreement.
  2. Service Agreement: The contract concluded between the Company and the user regarding the use of the service.
  3. Registration: The act of completing the service usage agreement by filling in the required information in the application form provided by the Company and agreeing to this agreement.
  4. Member: The individual who registers as a member on this site by providing the personal information required for membership.
  5. User Number (ID): A combination of alphanumeric characters selected by the user and approved by the Company for user identification and service usage.
  6. Password (PASSWORD): A combination of alphanumeric and special characters set by the user for the protection of their information.
  7. Termination of Use: The declaration of intent to terminate the service usage agreement after using the service by the Company or the member.

Article 3 (Effect and Amendment of Agreement)

If a member does not agree to the amended agreement, they can request membership withdrawal (termination). If a member continues to use the service even after 7 days from the effective date of the amended agreement, it is considered that the member has agreed to the changes in the agreement.

  1. The effectiveness of this agreement is established by posting it on the service screen or by notifying it through the notice board or other means.
  2. The Company can change the content of this agreement if it is deemed necessary, and the amended agreement is considered accepted if the user continues to use the service without expressing their refusal even after 7 days from the notice of the agreement's changes.
  3. If the user does not agree to the amended agreement, they can discontinue using the service and cancel their membership, but if they continue to use the service, the amended agreement is considered effective in the same manner as in the preceding paragraph.

Article 4 (Applicable Regulations)

Matters not specified in this agreement are governed by the provisions of the Telecommunications Basic Act, the Telecommunications Business Act, and other relevant laws and regulations.

Chapter 2 Service Usage Agreement Article 5 (Formation of Service Agreement)

The service agreement is established through the Company’s acceptance of the user’s service application and the user’s consent to the agreement’s contents.

Article 6 (Service Application)

Service applications can be made by the user on the service’s member information screen by recording personal information in the application form required by the Company.

Article 7 (Approval of Service Application)

  1. If a member accurately completes all the items on the application form and applies for the service, the Company accepts the service application unless there are special circumstances.
  2. The service approval may not be granted in the following cases:
    1. When applying under a name other than one's real name.
    2. When applying using someone else's name.
    3. When providing false information in the application.
    4. When applying with the intent to disrupt public order and standards of decency.
    5. When not meeting the requirements set by the Company for the service application.

Article 8 (Changes to Contractual Matters)

Members are responsible for making necessary modifications if the information they provided at the time-of-service application changes, and the responsibility for problems arising from not making such modifications lies with the member.

Chapter 3 Obligations of Contracting Parties Article 9 (Company’s Obligations)

The Company shall not disclose or distribute the personal information of members known in connection with the provision of services to third parties without the member’s consent.However, in cases where there is a request from a state agency due to the regulations of the Telecommunications Basic Act and other related laws, with the purpose of a criminal investigation, or through procedures specified by other relevant laws, this shall not apply.

Article 10 (Member’s Obligations)

  1. When using the service, members must not engage in any of the following actions:
    1. Using another member's ID inappropriately.
    2. Duplicating, publishing, or providing information obtained from the service to third parties.
    3. Infringing upon the Company's copyright, third-party copyrights, and other rights.
    4. Distributing content that violates public order and decency.
    5. Engaging in objectively determined actions associated with criminal activities.
    6. Violating other relevant laws and regulations.
  2. Members may not engage in business activities using the service, and the Company is not responsible for the results of business activities using the service.
  3. Members may not transfer or donate their service usage rights or other positions in the service usage agreement to others or provide them as collateral.

Chapter 4 Service Usage Article 11 (Member’s Responsibilities)

  1. Members are responsible for the maintenance of their own mail, bulletin boards, and registered materials as needed.
  2. Members may not arbitrarily delete or modify the data provided by the Company.
  3. Members must not post content on the Company's homepage that violates public order and standards of decency or infringes on third-party copyrights and other rights. If such content is posted, all responsibility for the consequences is borne by the member.

Article 12 (Management and Deletion of Posts)

For efficient service operation, the Company may limit members' memory space, message size, and retention period. Content that falls under the following categories may be deleted without prior notice:

  1. Content that slanders or defames other members or third parties.
  2. Content that violates public order and standards of decency.
  3. Content that is objectively deemed to be related to criminal activities.
  4. Content that infringes on the Company's copyrights, third-party copyrights, and other rights.
  5. Members posting explicit content on the Company's homepage or bulletin boards or linking to explicit websites.
  6. Content that is deemed to violate other relevant laws.

Article 13 (Copyright of Posts)

The copyright of posts belongs to the poster, and members may not use the material published on the service for commercial purposes, such as processing and selling it.

Article 14 (Service Hours)

Service usage is generally available 24 hours a day, 7 days a week unless there are specific interruptions due to business or technical reasons. However, regular inspections and other such reasons are exceptions.

Article 15 (Service Usage Responsibility)

Users are prohibited from engaging in actions such as hacking, linking to explicit websites, or illegal distribution of commercial software using the service. The company is not responsible for the results of business activities, losses, or legal actions taken by related agencies arising from violations of this prohibition.

Article 16 (Service Provide Terminate)

In the following cases, the service can be suspended:

  1. Due to necessary equipment maintenance or construction work
  2. If a period telecommunication service provider, as stipulated in the Telecommunications Business Act, suspends telecommunications services
  3. When system maintenance is required
  4. In cases of another force majeure

Chapter 5 Termination of Agreement and Restriction on Use Article 17 (Termination of Agreement and Use Restriction)

  1. If a member wishes to terminate the service agreement, they must apply for termination via the internet, and the Company will act after confirming the identity of the member.
  2. If a member has engaged in any of the following actions, the Company must notify the member and provide them an opportunity to express their opinion at least 30 days prior to taking termination action:
    1. Using someone else's user ID and password.
    2. Deliberately obstructing the operation of the service.
    3. Making a false registration.
    4. Registering multiple times under different user IDs.
    5. Disseminating content that disrupts public order and standards of decency.
    6. Defaming or causing harm to others' reputation.
    7. Sending a large amount of information through the service to interfere with its stable operation or sending advertising information.
    8. Distributing computer viruses or programs that may cause the malfunctioning of information and communication equipment.
    9. Infringing upon the intellectual property rights of the Company, other members, or third parties.
    10. Inappropriately using another person's personal information, user ID, and password.
    11. Posting explicit content on one's homepage or bulletin boards or linking to explicit websites.
    12. Violating other relevant laws and regulations.

Chapter 6 Miscellaneous Article 18 (Prohibition of Transfer)

Members may not transfer or donate their service usage rights, or other positions in the service usage agreement, or provide them as collateral to others.

Article 19 (Indemnification)

Except in cases where the Company’s willful misconduct or gross negligence has caused the member any harm, the Company is not responsible for any harm incurred by the member in relation to the services provided for free.

Article 20 (Exemption Clause)

  1. The Company shall be exempt from responsibility for providing the service in cases of force majeure, war, or other events beyond its control.
  2. The Company shall be exempt from responsibility for harm resulting from regular equipment maintenance, replacement, inspections, construction work, and other inevitable reasons.
  3. The Company shall not be responsible for service interruptions caused by the member's fault.
  4. The Company shall not be responsible for any profits or losses expected by the member through the service or any harm resulting from information obtained through the service.
  5. The Company shall not be responsible for the reliability, accuracy, or other aspects of the content, data, and facts posted by the member on the service.

Article 21 (Jurisdiction)

In the event of a dispute arising from service use, the exclusive jurisdictional court shall be the one in charge of the Company's location.

Supplementary Provision

(Effective Date) This agreement shall be effective from September 20, 2023.
